Terms of Service

Introduction

1. The following Terms of Service (“Terms”) govern the use of the Collect Comics iOS application (“App”) created by Uncanny Apps (“Company”). By downloading, installing,  or using the App, you agree to be bound by these Terms.

License

2. The Company grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You shall not use the App for any illegal or unauthorized purpose or in any manner that could damage the reputation of the Company.

User Content

3. The App allows you to submit and upload user-generated content, such as tags or photos (“User Content”). By submitting User Content, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize the Company to use your User Content in the manner contemplated by the App and these Terms.

Privacy

4. Your privacy is important to us. The Company's Privacy Policy governs the collection, use, and sharing of your personal information when you use the App. By using the App, you consent to the Company's Privacy Policy.

Intellectual Property

5. The App and its entire contents, features, and functionality are owned by the Company or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

6. THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. THE COMPANY MAKES NO WARRANTY THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, TIMELY, SECURE, OR BUG-FREE.

Limitation of Liability

7. YOU ACKNOWLEDGE AND AGREE THAT THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (iii) ANY CONTENT OBTAINED FROM THE APP; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Indemnification

8. You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Termination

9. The Company may terminate these Terms and your use of the App at any time, without notice, if you breach these Terms. Upon termination, all licenses and other rights granted to you under these Terms will immediately cease.

Governing Law

10. These Terms and your use of the App shall be governed by and construed in accordance with the laws of the state of Ohio, without giving effect to any principles of conflicts of law.

Amendments

11. The Company reserves the right to modify these Terms at any time, and you are responsible for regularly reviewing these Terms. Your continued use of the App after any modifications to these Terms shall constitute your agreement to be bound by such modifications.

Entire Agreement

12. These Terms constitute the entire agreement between you and the Company regarding your use of the App and supersede any prior or contemporaneous agreements between you and the Company.
